The EU’s General Product Safety Regulation (GPSR) exists precisely to fill this gap of the e-commerce age.

GPSR: a horizontal regulation updated for e-commerce

GPSR (General Product Safety Regulation, Regulation (EU) 2023/988) entered into force in June 2023 and has applied since 13 December 2024, replacing the old General Product Safety Directive 2001/95/EC that had been in force for over twenty years[1][2].

It is a ‘horizontal’ regulation—not aimed at a specific product, but covering the wide range of consumer goods that have no dedicated safety legislation. Decorative lights and similar goods often fall right into this horizontal net. The responsible economic operator: no listing without one

One of GPSR’s core designs is the requirement that every product sold in the EU have a responsible economic operator established within the EU[1].

This role can be the manufacturer, importer, authorized representative, or a fulfilment service provider—but the key point is that it must be within the EU, contactable, and responsible for product safety. Its name and contact details must be findable by regulators and consumers.

For sellers shipping goods directly into the EU from outside through e-commerce, this is a structural change. The old model of shipping direct with ‘no EU importer’ no longer works under GPSR—without a designated EU-based responsible person, the platform is obliged to refuse the listing or, once notified, take it down. The responsible economic operator has become the entry ticket to the EU market.

Traceability and incident reporting: pinning down the problem product

What safety regulation ultimately serves is ‘being able to clean up when something goes wrong.’ GPSR therefore stresses traceability: a product must be identifiable—marked with the model, batch or serial number, and the information of the manufacturer and responsible operator—so that authorities can locate the specific problem product[1].

When a product is found to have caused an incident or to pose a risk, the economic operator is obliged to report to the competent authorities through the EU’s reporting mechanism (Safety Gate / Safety Business Gateway) and take corrective action. Traceability information is key here: it decides whether a recall can ‘pin down the exact scope’ rather than sweep up every batch. Done well, traceability actually makes a recall cheaper.

The other side of the Atlantic: the US CPSC and CPSIA

Cross-border e-commerce rarely serves a single market. The US framework is similar to the EU’s in spirit but different in mechanism.

The US oversees consumer-product safety through the Consumer Product Safety Commission (CPSC), and one key piece of legislation is the Consumer Product Safety Improvement Act (CPSIA) of 2008[3]. CPSIA strengthened third-party testing and certification, tracking labels, limits on substances such as lead and phthalates, and raised penalties for violations. Decorative lights—goods that contain electrical components and often circulate in bulk around the holidays—are exactly the kind of product these rules watch.

The EU takes a horizontal path of ‘responsible person + traceability + reporting’; the US relies mainly on CPSC’s specific rules and testing certification.
